These Terms and Conditions ("Terms") constitute a binding agreement between Vihan Trust ("Vihan Trust," "we," "us," or "our"), a non-governmental organisation registered and operating from No. 30-A, Colony 3rd Street, Thachanallur, Tirunelveli – 627358, Tamil Nadu, India, and any individual, institution, donor, volunteer, or other entity ("User," "you," or "your") who accesses or uses the website www.vihantrust.org ("Site") or any services, programmes, or resources offered through the Site ("Services").

By accessing the Site, making a donation, registering as a volunteer, subscribing to our newsletter, or otherwise using any of our Services, you agree to be bound by these Terms. If you do not agree, please refrain from using the Site or Services.

These Terms shall be read together with Vihan Trust’s Privacy Policy and any additional programme-specific guidelines published on the Site from time to time.

I. Registration and User Accounts

A. Registration

• Users may be required to register for donations, volunteering, or programme participation.
• You agree that all information provided is true, accurate, current, and complete.
• You must be at least 18 years of age and legally capable of entering into binding agreements.
• Personal information is handled according to our Privacy Policy.
• You are responsible for maintaining the confidentiality of your account credentials.

II. Use of the Site and Services

A. General Conditions

• The Site is primarily intended for users in India.
• Vihan Trust may suspend, restrict, or terminate access at its sole discretion.
• Services are provided on an "as is" basis without warranties of any kind.
• Users must comply with all applicable Indian laws, including FCRA and Income Tax regulations where applicable.
• You agree not to misuse the Site for illegal, harmful, fraudulent, or abusive purposes.

Prohibited Activities include:

• Harassment, abuse, or defamation
• Spam, fraudulent schemes, or misleading promotions
• Uploading viruses or harmful software
• Violating intellectual property rights
• Promoting unlawful goods or services

III. Donations and Payments

• Donations are voluntary and support Vihan Trust’s charitable objectives.
• Accepted methods may include UPI, cards, net banking, cheque, or demand draft.
• Donations are generally non-refundable except in duplicate or technical error cases.
• Refund requests must be submitted within 7 days to admin@vihantrust.org.
• Eligible donors may receive Section 80G receipts subject to applicable law.

IV. Volunteer Participation

• Volunteer applications may be accepted or declined at Vihan Trust’s discretion.
• Volunteers must uphold confidentiality and organisational values.
• Volunteers may not represent Vihan Trust without written authorisation.
• Volunteer participation may be terminated for policy or legal violations.

V. Content and Intellectual Property

• All website content, including logos, text, graphics, and programme materials, belongs to or is licensed to Vihan Trust.
• No material may be copied, distributed, or commercially used without prior written permission.
• User-submitted content grants Vihan Trust a non-exclusive right to use it for organisational purposes.

VI. Privacy

Your use of the Site is also governed by Vihan Trust’s Privacy Policy. By using the Site, you consent to our collection and use of information as described therein.

VII. Limitation of Liability

To the fullest extent permitted by law, Vihan Trust shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Site, Services, donations, volunteer participation, or third-party interactions.

VIII. Indemnification

You agree to indemnify and hold harmless Vihan Trust, its trustees, officers, employees, and volunteers from any claims, damages, or legal expenses arising from your misuse of the Site, violation of these Terms, or breach of applicable law.

IX. Force Majeure

Vihan Trust shall not be held responsible for delays or failures caused by events beyond its control, including natural disasters, government actions, internet failures, or public emergencies.

X. Modifications to Terms

Vihan Trust reserves the right to revise these Terms at any time. Updated Terms will be posted on the Site, and continued use constitutes acceptance.

XI. Termination

Vihan Trust may suspend or terminate your access to the Site or Services at any time without notice for violations of these Terms or applicable law.

XII. Dispute Resolution and Governing Law

• These Terms are governed by the laws of India.
• Parties shall first attempt amicable resolution within 30 days.
• Unresolved disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996.
• The seat of arbitration shall be Tirunelveli, Tamil Nadu, India.
• Tirunelveli courts shall have exclusive jurisdiction where arbitration does not apply.

XIII. Miscellaneous

• Severability: Invalid provisions shall not affect remaining Terms.
• Entire Agreement: These Terms and Privacy Policy form the full agreement.
• No Waiver: Failure to enforce any provision is not a waiver.
• No Agency: These Terms do not create employment or partnership.
• Survival: Key provisions survive termination.
